Just goes to show two things: that eBay is the home of spivs and shysters and that sadly people remain gullible to them.

I dont think there is a problem with this.
Actually, in my opinion, its quite positive, because a person looking for an audio editor in eBay will come across Audacity and maybe get curious enough to search for it (or even buy it from this person). Also, the cost for the service of downloading, burning and sending the application (Free Software or not) on CD to your door, doesnt seem to high to me. ps. Linuxiso.org has been doing this for ages (with whole Linux distributions) and no one calls them a rip off. ps2. Instead of complaining about him selling the software, maybe you could ask him to donate a percentage of the sells... dont you think?
The seller isn't sending a CD - he's offering it as a direct download. I still don't see a problem since the price is so low. In fact, I bought an Open Office distro off ebay 3 years ago - it's how as a newbie I was introduced to Open Source software. I quickly learned I could have downloaded it but I wasn't upset - for a small fee I was given an education in something I wasn't aware of yet - the open source community. At least the buyer gets somethig he can actually use - unlike the proliferation of crappy ebooks and cookie cutter webstores that will never earn a nickel that are offered for sale every day.
